Penalty for conspiracy to defraud
11.10 The Attorney General's Chambers continued to consider revising the penalty for conspiracy to defraud and it is likely the proposal will be that the maximum be increased to 14 years' imprisonment.
Amendment to the Immigration Ordinance (Cap 115)
11.11 The Standing Liaison Committee considered an amendment to the Immigration Ordinance to provide that arrival and department chops in passports be prima facie proof for the prosecution that the passport holder was in the place stated on the date indicated on the chop. Drafting instructions will issue after further consultation between the Immigration Department and the Security Branch.
FUTURE ACTION
11.12 Working through its Operational Targetting Committee, the Standing Liaison Committee will continue to investigate serious cases of commercial crime and to prosecute offenders. It will also continue to consider the problems of -
(a)
(b)
(c)
computer crime;
deletion of secrecy provisions from the Securities and the Commodities Trading Ordinances;
jurisdiction to prosecute crimes where any material element is committed in Hong Kong; and
(d) inertia selling.
