The Council

Council also has a major role in considering

petitions which are made under rights conferred under a

number of Ordinances (in all, 80 Ordinances provide a right

of appeal to the Governor in Council). For example, a

hawker who is aggrieved by a decision of the Urban Council

to cancel his licence may petition the Governor in Council

under the Public Health and Municipal Services

Municipal Services Ordinance.

Similarly under the Medical and Health Ordinance, a person detained in the Siu Lam Psychiatric Centre may petition the

Council against the continuation

of the Hospital Order

whereby he is detained.

Another important duty is laid on the Council by

the Immigration Ordinance which requires that any proposals

to deport aliens who have fallen foul of the law in Hong

Kong should be laid before the Council.

One of the Council's most solemn duties is to

advise the Governor on the commutation of death sentences

in

In addition to providing advice on the wide range

of matters presented for decision, the Council is regularly

informed of important developments in Hong Kong.

This may

be done by means of briefings by senior officials such as

the Commissioner of Police and the Commissioner Against

Corruption who make regular appearances before the Council,

or by means of information notes.
