If it appeared desirable that a component similar to the appointed members now in the Council should continue to exist in the Special Administrative Region Legislature, the Chief Executive could present them in a list to the electoral college either separately or in a list together with the officials. The electoral college would through an electoral process choose the required number of people from the list to fill the designated seats in the Legislature.

Great care would need to be taken to strike the right balance between the numbers chosen by the different methods to avoid allegations that the Chief Executive had in practice a majority of his own appointees in the Legislature. To avoid this accusation, the total of official and other members elected by the electoral college would have to be significantly smaller than the total chosen by other forms of election.

It would also be important to allow for future flexibility in the proportions of members chosen by the various methods (see paragraph 4 of the accompanying paper "Issues connected with the question of convergence".)
