FORMAT OF THE BASIC LAW

18.

One of the first tasks of the BLDC at its second

meeting in April will be to decide on the format (or structure) of the Basic Law, ie how its chapters, sections and paragraphs should be arranged and what should be included in them. Recent indications from Chinese sources

point to the following possible structure:

its General principles: the legal basis of the Basic Law, relationship with the State's Constitution and the central government's aims and policies regarding the "one

country, two systems" concept.

Relationship between the central government and the Hong of the Kong Special Administrative Region: definition central government's jurisdiction over Hong Kong and the jurisdiction of the SAR Government within Hong Kong.

Hong Kong people's rights and obligations: statement of the obligations (eg to uphold the unification of China and to safeguard Hong Kong's stability and prosperity) and the rights and freedoms of Hong Kong people.

Specific provisions for Hong Kong's political system and

the structure,

selection government

and appointment of

the Chief Executive etc.

Elaborating on the social, cultural and other systems to

be practised in the Hong Kong SAR.
