extends the current maximum of 3 additional

months);

a travel document beyond the initial period

to be given to the former holder; and

to specify that a notice to surrender, once served, cannot be withdrawn (the appropriate

manner of seeking a return of travel

documents being provided by new section 17B).

11. Clause 10 inserts two new sections.

Section

17B deals generally with the return of travel documents

surrendered under section 17A. It provides that the former

holder may apply to the Commissioner at any time for the

return of a travel document. The Commissioner may return

the travel document without conditions or with conditions

as to the further surrender of the document at a future

time.

Where the Commissioner refuses to return the travel

document, the former holder may appeal to a magistrate

who may, if he is satisfied that the continued detention

of the travel document would cause unreasonable hardship,

order the return of the travel document. The magistrate

may also impose conditions as to the further surrender

of the document.

Failure by the holder to comply with

a notice or order for further surrender of the travel

document will have the same effect as a failure to comply

with the original notice to surrender. This section
