(a)

require that any property or

document of title thereto be

deposited with him or with such

other person as he may direct

by the holder or a surety or by

both the holder and a surety to

be retained by the magistrate

or by such person until such

time as the recognizances under

this section are no longer

required or are forfeited and

enforced.

(3) If the holder does not appear

on the day and at the time and place

specified by the magistrate under

subsection (2), a magistrate may declare

or order that any recognizance entered

into, and any sun of money deposited, by

the holder or a surety under subsection (2)

be forfeited.

(4) Without prejudice to subsection

(5), the provisions of section 64 (mode

of giving security and enforcement thereof)

and section 65 (enforcing recognizance

for appearance) of the Magistrates

Ordinance shall apply, mutatis mutandis

to recognizances under this section.
