17C.
(1) Notwithstanding anything
in section 173, where it appears
(a) to the Commissioner upon an
application to him under
section 17B(1); or
(b)
to a magistrate upon an appeal
under section 17B(3),
:
that the return of a travel document
surrendered under section 17A is required
by the holder for the purpose of leaving
Hong Kong during the course of the
investigation referred to in that section,
the travel document shall not be returned
to the holder unless the Commissioner or
the magistrate as the case may be, is 'satisfied that sufficient security (whether
in the form referred to in this section or
in some other form) has been given to ensure
the appearance of the holder in Hong Kong
on such future day and at such time and
place as may be required for the purposes
of the investigation.
