The Judiciary

The question has arisen as to whether the Judiciary can and should be made completely independent from the public service and I have been asked to find out the position in other Commonwealth countries.

From the limited information available here it appears that although Judicial Officers are independent in the exercise of their judicial functions, and there are special arrangements for their appointment and removal from office, Judiciaries as organisations are nevertheless part of the public service. In the UK for example, the Judiciary as described in the civil service year book seems indistinguishable from other Government departments. However, as I have said, we have very little information here and I should be grateful for any advice you can obtain for me in this matter.
