Amend the Public Finance Ordinance.

Enacted by the Governor of Hong Kong, with the advice and consent of the

Legislative Council thereof.

1. This Ordinance may be cited as the Public Finance (Amendment) Ordinance Short title. 1985.

Section 29 of the principal Ordinance is amended—

(a) in subsection (1) by inserting after "purpose" the following—

", and such other moneys received for the purposes of the Government as may be specified in the resolution.";

(b) by inserting after subsection (1) the following—

"(1A) Moneys specified in a resolution passed under subsection (1) in respect of any fund shall, if such moneys have not been appropriated for the purpose of the fund when the resolution is passed, be deemed to be appropriated thereby for that purpose; and this subsection shall apply in relation to any such resolution whether passed before or after the commencement of the Public Finance (Amendment) Ordinance 1985.".

Explanatory Memorandum

This Bill amends the Public Finance Ordinance to enable specified public moneys to be paid directly into funds established by resolution of the Legislative

Council. The amendment will only apply where the relevant resolution contains express provision specifying the public moneys in question.

2. The Bill has no Public Service staffing or, except as indicated, public expenditure implications.
