The Ordinance has not been repealed. However it has been omitted from the List of Ordinances and is considered as spent of effect.
(ii) Expired Leases - land is currently occupied by the military where
the original lease has expired but has not been renewed or replaced
by other forms of documentation.
(iii) Monthly Licences
(iv) Areas reserved through correspondence for naval burials.

(v) Gazetted area under the Emergency (Acquisition) Regulations 1949
(Cap. 241) an area at Sai Wan is expressed to have been gazetted
under these Regulations as a Firing Area. This does not appear
possible under the terms of the Regulations but can be checked if
required. Copy Ordinance marked 'M' attached.
(vi) Gazetted areas under the Defence (Firing Areas) Ordinance (Cap. 196)
- Under this Ordinance certain areas are designated as firing areas.
Section 11 provides that the Governor-in-Council may amend the firing
areas. Copy Ordinance marked 'N' attached.
Note:
Rather than simply list the different instruments under which
the MOD holds property in Hong Kong I have attempted in each
case to give a brief account of what the instrument purports
to effect. In order to do this I have referred to individual
cases and it is conceivable therefore that a Memorandum of
Transfer, for instance, in another case may contain different
provisions and have a different effect than the example
quoted above. To check each individual instrument would be
a very time consuming exercise.
