HONG KONG AGREEMENT : RESTRICTED : BASIC LAW CONSULTATIVE COMMITTEE

THE BASIC LAW CONSULTATIVE COMMITTEE (BLCC) MET ON 6 DECEMBER TO FORM AN EXECUTIVE COMMITTEE OF 19 AND, FROM THEM, TO SELECT A TEAM OF SEVEN OFFICE BEARERS. THE METHOD USED FOR THE SELECTION OF OFFICE BEARERS HAS DEVELOPED INTO A PUBLIC CONTROVERSY.

2. THE EXECUTIVE COMMITTEE WAS ELECTED BY SECRET BALLOT AT THE FULL MEETING FROM A SHORT LIST OF CANDIDATES (32 IN NUMBER) EACH OF WHOM HAD BEEN PROPOSED AND SUPPORTED BY AT LEAST 20 OTHER BLCC MEMBERS. THE NEWLY-ELECTED EXECUTIVE COMMITTEE THEN PROCEEDED TO ELECT THE OFFICE BEARERS. UNDER SECTION 9.3 OF THE BLCC CONSTITUTION, A CHAIRMAN, FIVE VICE-CHAIRMEN AND ONE SECRETARY-GENERAL ARE TO BE - ELECTED BY THE EXECUTIVE COMMITTEE MEMBERS OF THE BLCC BY VOTING AMONG THEMSELVES. HOWEVER, ACCORDING TO MEDIA AND OTHER REPORTS, THE ELECTION PROCEDURE UNDER SECTION 9.3 WAS NOT FOLLOWED. INSTEAD THE FOUR VICE-CHAIRMEN OF THE BASIC LAW DRAFTING COMMITTEE IN HONG KONG (XU JPATUN, FEM YIMIN, Y.K. PAO AND DAVID LF) PRODUCED A LIST OF OFFICE-BEARERS, WHICH WAS THEN ADOPTED WITHOUT DISSENT BY THE EXECUTIVE COMMITTEE MEMBERS.
