1. The new Home Office draft incorporates many of our and Hong

Kong's comments and is a good basis for final negotiations with Hong

Kong at official level. Should send it to Hong Kong after meeting,

with explanation of why we have not incorporated some of their

proposed amendments, and asking for their comments on the revised

draft. Their comments can serve as the basis for discussion at the

end of the month.

RIGHT OF ABODE

2. Problem of those who lose BDTC status on 1 July 1997, but do not

have right of abode in Hong Kong. Ministers have said that BN (O)

passport holders will have right of abode in Hong Kong stated in

their passports. If some do not will have even greater trouble with

Visa Abolition Agreements, and could face claim by those without

right of abode that they should not lose BDTC status. Probably very few such people, who probably have right of abode elsewhere anyway.
