Article 7(3) fulfils the commitment that BN(0)s will be

Commonwealth citizens. But we still need to decide, in the light of

FCO's reservation about making the point so bluntly, whether BN (0)s should

be Commonwealth citizens, or whether they should merely be treated as if

they were. If the latter a different form of words will be needed.

Whatever is decided will need to be defensible in terms of the commitment

given. It would seem preferable, and less open to question, simply to

include BN(0)s in section 37 of the 1981 Act.

30. Article 7(4) to 7(11) are self-explanatory, and aim to encompass

all the other amendments which will be necessary to the 1981 Act.

In

particular Article 7(4)(d) excludes the possibility of imposing fees for

acquiring BN (0), but allows fees to be imposed for the registration as a

BOC of qualified grandchildren under Article 6(3).

Consequential amendments

31.

Article 8 sets out the consequential amendments which will be

necessary to the other enactments specified in the Schedule to the Order.

It needs further attention, particularly as regards Acts passed after 1981.
