1. Hong Kong telno 337 gives Hong Kong's views. on the first draft

Order. We are awaiting their views on the second draft. The Home

Office will only just have seen Mr Hill s proposed redraft of the

Order in Council.

2. There are three alternative definitions of the persons who will

lose BDTC status on

1 July 1997 and will be eligible to apply for

BN(O) status:

a)

a list of all categories of BDTC involved (agreed by all to be very long and cumbersome)

b) Hong Kong Belongers

c)

3.

a general formula, as used in the revised draft Oder, based

on our Legal Advisers' proposal.

The Home Office favour the use of the Hong Kong belonger

definition and are likely to press for it at the meeting. Hong Kong

oppose it because not all Hong Kong belongers are BDTCs, nor are all BDTCs Hong Kong belongers. Furthermore, Lu Ping opposed the use of
