1. You will have seen Hong Kong telno 68T giving Hong Kong's views
on Mr Hill's redraft of the Order. (Mr Hill's minute of 22
February). Hong Kong have not seen Mr Grainger's further draft of
the first five Articles (Mr Grainger's minute of 15 March) and the
Home Office have yet to comment on these.
2. I attach a copy of Mr Hill's redraft into which we have
incorporated Hong Kong's suggested amendments. I should be grateful for your views on these proposed amendments. Following that I suggest a meeting with the Home Office to discuss them.
3. Hong Kong's amendments essentially cover:
(a) Their suggestions for dealing with 'hard' cases of 'mixed'
BDTC's.
(b) Other suggested modifications and refinements to the various
Articles of the draft Order.
4.
On para 3(a) above, you know that my view of the intentions
behind the UK Memorandum is the same as Hong Kong's (para 1(B) of Hong Kong telno 681). Hong Kong's redraft of Article 3 of the Order
is designed to ensure that 'mixed' BDTC's whose real connections are
not with Hong Kong will be exempted from loss of their BDTC status.
I doubt whether the numbers involved would be substantial.
