The Home
We have already advised on the interpretation of the UK Memorandum (Mr Grainger's minute of 15 March), and in particular the conflict between that Memorandum and certain suggestions for dealing with "hard" cases of "mixed" BDTC's. Mr Grainger has also commented on Hong Kong telegram no 681 in his minute of 15 April (which appears to have crossed with yours of the same date). Hong Kong's proposals also appear to be in conflict with the UK Memorandum.

You may however be right in thinking that the Chinese would not object to these sort of departures from the Memorandum. It would indeed take a formidable knowledge of our nationality law and its complexities to detect the discrepancies. Whether we should take a chance on the Chinese not objecting is however a question of policy.
3. Before further drafting work is done what is required is an instruction on what results, as a matter of policy, you wish us to achieve. In particular what hard cases of mixed BDTC's do you wish to be allowed to retain that status, notwithstanding the UK Memorandum. Given such instructions legal advisers can of course assist with the drafting.
