HONG KONG BILL

I attach a copy of the Notes on Clauses and background briefing which we are submitting to our Ministers for approval.

It is based on the material you provided, but we have suggested some amendments and additions, as well as some rearrangement of the Order.

The main changes are:

a) Paragraph 2 The powers to be taken in the Order in Council go rather

wider than the terms of the UK Memorandum. We have suggested an amendment to make this clear.

b) Paragraphs 3, 4 and 5 The Order in Council will cover the nationality

provisions only of the Memorandum, and not those relating to passport issue etc. It may therefore be a bit misleading to refer to passport matters as part of the note on paragraph 2, since no mention of these matters is to be found there.

We have therefore suggested separating the nationality provisions of the Memorandum from those relating to passports. Thus our paragraphs 3 and 4 cover the nationality provisions, while paragraph 5 contains, for information, the rest of the UK Memorandum, making it clear that this is not part of the legislation.

c) Paragraphs 11 et seq We have extended and re-ordered your original

material, which we assume is intended for your Minister's eyes only. You indicated that a copy of your further detailed briefing material is on its way to us. We will deal with this as soon as it arrives and let you have comments as quickly as possible.
