NATIONALITY: ORDER IN COUNCIL
1. I enclose a copy of a draft Order-in-Council which we have received from the Home Office. You will wish to note the following points:-
a) The title "British National (Overseas)" has been used throughout;

the draft incorporates the formula for defining those affected that was set out in paragraph 2 of FCO telno 047. If this approach was agreed, the Home Office would propose to attach a list of the categories affected as an annex to the Order; have today riceved your libos
it is assumed that no fee will be payable for registration as a BN(0);
that three cut-off dates proposed in Article 3(2) are illustrations. You are clearly best placed to judge how much time you will need to ensure that all applications are processed, and passports issued, by the due dates;
the Home Office would be grateful for confirmation that the Immigration Ordinance referred to in the draft is the current version, and is up to date;
Home Office officials were told by Stephen Kuo that you had considered making an amendment to the Ordinance to give Hong Kong belonger status to women registered in Hong Kong under section 20 of the BNA 1981 by virtue of their marriage to a KC who became a BDTC on 1 January 1983 but who did not himself have a qualifying connection with Hong Kong.
