1. I spoke today to Mr Davis, Legal Adviser MAFF (7749), who dealt with the Dairy Produce Quoas Regulation 1984.

Action Taken

He told me that the procedure devised for this Order had been one of political rather than legal expediency. MAFF laid the Order in draft in the normal way for approval under affirmative resolution procedures. There was so much opposition to it from backbench constituencies that the Minister allowed an adjournment debate on the Order and other related matters. In light of this debate MAFF withdrew the Order and laid a revised version on 16 July, which debated in unamendable form on 16 July.

3. I do not therefore think that we need to worry too much about whether Ministers say at Committee Stage that we will lay the nationality order in draft or that we will lay the terms of the Order before Parliament, as either would be acceptable. We should refer in general terms to the precedent of the Dairy Produce Quotas Regulation 1984.
