I attach an amended version of the draft attached to your minute of 9 January. A copy of the final version of these notes should be sent for information to Mr de Waal (Parliamentary Counsel).

I see from the Guide to Legislative Procedures that Notes on Clauses are sometimes made available to Members of Parliament. For this reason I have suggested the removal of a reference to "probably difficult consultation with the Hong Kong Government and the Executive Council". If however you consider it necessary to warn Ministers of that point you might wish to indicate that it is for Ministers' eyes only.

3. The same consideration applies to the section on Privileges and Immunities where, with reference to paragraph 4 of the schedule, I have added the warning note that the Chinese might refuse to regard it as appropriate to grant privileges and immunities in Peking to any members of the Joint Liaison Group from Hong Kong
