Our
The drafting of the Basic Law is a very difficult task. I wonder if I may describe the HK SAR as a "building." The general design framework for this building has been laid down by China's fundamental policy towards HK contained in the Sino-British Joint Declaration. task now is to design a complete design blueprint for this IK SAR building. The building is a unique and complex project that requires pooling the wisdom of the people for the formulation of the best and carefully designed draft. This relies on the concerted efforts not
only of all members of the BLDC and the BLCC, but also of all compatriots in HK as well as people from various sectors. We sincerely hope and warmly welcome people from various sectors in HK to express views and make positive suggestions on the drafting of the Basic Law through the BLCC or various other channels. Let us be the designers for this HK SAR building and contribute our ideas to the drawing up of a design blueprint.
Drafting the Basic Law in accordance with the Joint Declaration is a principle that must be adhered to in the drafting process. The Chinese Government has put forward a full set of policies on HK, on the basis of the "one country, two systems" concept. These policies have been incorporated in the Joint Declaration. The Chinese Government's policies towards HK have specified that the HK SAR will have a high degree of autonomy. It will be administered by local residents and will enjoy the power of administration, the power to legislate, an independent judiciary and the power of final ad judication. Existing social and economic systems will remain unchanged. The way of life will remain unchanged. Existing laws will remain basically unchanged. The territory will remain financially independent. Its position as a free port and its status as a separate customs territory as well as an international financial centre will be preserved. At the same time the policies of the Chinese Government also specify that the HK SAR will be directly under the central people's government which will be responsible for the region's diplomatic and defence affairs. The chief executive will be selected in HK through elections or consultation and will be appointed by the Central People's Government. Principal officials of the SAR will also be appointed by the Central People's Government. The Basic Law of the SAR will be drafted and promulgated by the NPC. The Chinese Government's policies in these regards are a manisfestation of the "one country, two systems" principle. There is no precedent in drafting the HK SAR Basic Law in accordance with the country, two systems" principle. On the one hand, HK and the mainland adopt different systems. It is impracticable to copy the systems from the mainland. On the other hand, as HK is part of China, it is also inappropriate to copy the system from foreign countries. Therefore, in drafting the Basic Law, we should start on the basis of HK's actual conditions and should fully and accurately adhere to the "one country,
