The Council ADVISED and the Governor ORDERED:

(a) that the Protection of Wages on

Insolvency Bill 1985, as annexed

to the memorandum should not be

introduced into the Legislative

Council

pending

further

consideration of -

(i)

measures to deter employers

from reliance

on

the

Commissioner for Labour's

discretion to make payments

from the fund in the

absence of a petition for

winding up or bankruptcy;

(ii) guidelines, whether by way

of legislation or

of

administrative instructions,

as to criteria (e.g. the

level of wages or the

number of workers) which

should govern the exercise

of

the

Commissioner's

discretion to make payments

from the fund in the

absence of such a petition;
