EXECUTIVE COUNCIL DECISION ON 30.3.82

The Council noted the contents of memorandum

After discussion the Council AGREED that:

there was a black area where there would be strong interests, generally easy to define, which would require either exclusion from circulation and/or vithdraval;

memoranda would be withheld from a member only on the authority of the Chief Secretary;

in the grey area where a question of degree of interest could arise or where the precise subject of the paper could be relevant, the Governor vould make a decision on whether the member should vithdraw;

the details of the interest should be minuted:

vhere members vere on advisory boards or committees, their position should be declared and noted in the minutes but no question of withdrawal would arise;

periodic circulation of lists of membership of advisory bodies would serve little purpose;

(g) members should inform the Chief Secretary

or Attorney General in difficult cases of their interest as far as possible in advance and make a declaration when the item was about to be discussed; the Clerk of Councils should advise members of memoranda where a possible question of interest might arise.
