An Ordinance to amend the Water Pollution Control Ordinance.

[12 July 1985]

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.

1. This Ordinance may be cited as the Water Pollution Control (Amendment) Short title. Ordinance 1985.

2. Section 8 of the principal Ordinance is amended in subsection (3) by deleting Amendment of paragraph (b).

section 8. (Cap. 358.) Section 25 of the principal Ordinance is amended in subsection (1) by Amendment of inserting after "compensation" the following-

section 25.

"to the person whose licence is cancelled or varied".

Section 26 of the principal Ordinance is amended—

(a) in subsection (1) by deleting the full stop and substituting the following-

"to the person who is making the discharge or deposit."; and

(b) in subsection (2) by deleting the full stop and substituting the following-

"to the person whose licence is cancelled or varied.".

5. The Second Schedule to the principal Ordinance is amended--

(a) in paragraph 3 by deleting "a tribunal; and the Authority shall thereupon refer the claim with the particulars thereof to a tribunal, consisting of a District Judge nominated by the Chief Justice for the purpose.' and substituting the following—

"the Lands Tribunal and the Authority shall thereupon refer the claim with the particulars thereof to the Lands Tribunal.”;

(b) by deleting paragraphs 4, 5, 6, 7 and 9; and

(c) in paragraph 8 by deleting "tribunal" in both places where it appears and

substituting the following-

"Lands Tribunal".

Amendment of section 26.

Amendment of Second Schedule.

(1) The Lands Tribunal Ordinance is amended by inserting at the end of Consequential the Schedule the following—

"358.

Water Pollution Control Ordinance.".

(2) The Shipping and Port Control Ordinance is amended in section 48A by (Cap. 313.) deleting "section 9 of".
