An Ordinance to amend the law relating to District Boards and to elections to District Boards, the Legislative Council and the Urban Council and to make provision for elections to the Regional Council and for matters connected therewith.

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.
ELECTIONS (MISCELLANEOUS AMENDMENTS)

3. The first principal Ordinance is amended by adding after section 3 the Addition of following-
"Declaration of Urban Council
area and Regional Council area.

3A. (1) The Governor in Council may, by order published in the Gazette, by reference to Districts delcare any area in Hong Kong to be
(a) the Urban Council area; or
(b) the Regional Council area.
(2) Where the Governor in Council makes an order amending or revoking an order made under subsection (1) such first mentioned order may make such transitional provisions relating to such amend- ment or revocation as may be necessary or expedient.".
Section 6(1) of the first principal Ordinance is amended
(a) in paragraph (b) by deleting "New Territories District Board" and substitut-
ing the following-
"District Board in the Regional Council area"; and
(b) in paragraph (e) by deleting “an urban areas District Board" and substitut-
ing the following-
section 3A.

Amendment of section 6.
Short title and commencement.
PART I
PRELIMINARY
1. This Ordinance may be cited as the Elections (Miscellaneous Amendments) Ordinance 1985 and shall come into operation on a day to be appointed by the Governor by notice in the Gazette.
PART II
AMENDMENTS to the District Boards ORDINANCE
"a District Board in the Urban Council area”.

Section 8 of the first principal Ordinance is amended—
(a) in paragraph (a) by inserting after "ordinary election" the following—
"for District Boards"; and
(b) in paragraph (b) by deleting "at a by-election" and substituting the
following-
"to fill a vacancy caused by an elected member ceasing to be a member in accordance with section 14”.

Section 2 of the District Boards Ordinance (“the first principal Ordinance")
section 2.
is amended---
(a) in paragraph (d) by deleting "a foreign country or a salaried functionary of
a foreign government" and substituting the following—

(a) by deleting the definition of "by-election";
(b) in the definition of "Designated Officer"
(i) in paragraph (a) by deleting "New Territories District or District Board" and substituting the following—
"District or District Board in the Regional Council area”; and (ii) in paragraph (b) by deleting "urban areas District or District Board" and substituting the following-
"District or District Board in the Urban Council area";
(c) by deleting the definitions of "New Territories District" and "New Territor-
ies District Board";
(d) by inserting after the definition of "ordinary election" the following
definitions-
""Regional Council area" means the area so declared under section
3A(1)(b);
"Urban Council area" means the area so declared under section
3A(1)(a)."; and
(e) by deleting the definitions of "urban areas District" and "urban area
District Board".

"any place outside Hong Kong or a salaried functionary of a govern- ment of such place"; and
by inserting after paragraph (e) the following—
“(ea) is the subject of a decision under the Mental Health Ordinance that he is of unsound mind and incapable of managing himself and his affairs, but a person disqualified under this paragraph shall be eligible for re-election if under that Ordinance it is subsequently found that his unsoundness of mind has ceased;".
Section 9A of the first principal Ordinance is amended-
(a) in paragraph (c) by deleting “a foreign country or a salaried functionary of a
foreign government" and substituting the following-
"any place outside Hong Kong or a salaried functionary of a govern- ment of such place";
(b) by inserting after paragraph (d) the following—

(Cap. 136.) '(da) is the subject of a decision under the Mental Health Ordinance that he is of unsound mind and incapable of managing himself and his affairs;";
(c) by being renumbered as subsection (1); and
