An Ordinance to amend the Landlord and Tenant (Consolidation) Ordinance, and

make minor, related amendments to the Lands Tribunal Ordinance.

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.

1. (1) This Ordinance may be cited as the Landlord and Tenant (Consolida- tion) (Amendment) Ordinance 1985.

(2) Subject to subsection (3), this Ordinance shall come into operation on 1 July 1985.

(3) Sections 8 and 15 shall come into operation on 19 December 1985.

2. Section 10(1) of the principal Ordinance is amended by deleting “21” and substituting the following--

"27".

3. Section 18 of the principal Ordinance is amended—

(a) in subsection (2)(c), by inserting after "execution" the following—

", with such fee as may be determined by the Financial Secretary”; and (b) in subsection (3)(c) by deleting and on payment by the person lodging the

agreement of such fee as may be determined by the Financial Secretary".

Section 28 of the principal Ordinance is amended-

Amendment of section 33.

(a) in subsection (2), by inserting after "agreement" the following—

"and such fee as may be determined by the Financial Secretary”; and (b) in subsection (3) by deleting “, on payment by the parties of such fee as may

be determined by the Financial Secretary,”.

5. Section 30 of the principal Ordinance is amended by deleting "it" and substituting the following-

Section 33(1)(ƒ) of the principal Ordinance is amended by deleting "the Colony" and substituting the following—

Section 39 of the principal Ordinance is amended-

(a) in subsection (1)(a) and (c) by deleting “the Colony" wherever it occurs and

substituting in each case the following--

"Hong Kong"; and

"$30,000".

Section 51 of the principal Ordinance is amended by deleting subsection Amendment of

(4C).

10. Section 51C of the principal Ordinance is amended—

(a) in subsection (2) by inserting after “subsection (1)" the following—

"and of such fee as may be determined by the Financial Secretary”; and

(b) by deleting subsection (3).

11. Section 52A of the principal Ordinance is amended-

(a) in subsection (2)(b), by inserting after "execution" the following—

", with such fee as may be determined by the Financial Secretary"; and

(b) in subsection (3)(c) by deleting "and on payment by the person lodging the

agreement of such fee as may be determined by the Financial Secretary".

12. Section 53 of the principal Ordinance is amended-

(a) in subsection (7A)(a)(ii) by deleting "authorize him" and substituting the

following-

", on an application accompanied by such fee as may be determined by the Financial Secretary, authorize the applicant"; and

(b) in subsection (8) by inserting after "Tribunal" in the second place where it

occurs the following-

"or, as the case may be, the court referred to in subsection (7C)”.

Amendment of section 52A.

Amendment of section 53.

13. Section 53A(2)(b) of the principal Ordinance is amended by deleting "new Amendment of building be commenced and completed" and substituting the following—

"rebuilding work (including any demolition that is required) be commenced, and the new building be ready for occupation,”.

14. Section 55 of the principal Ordinance is amended---

(a) in subsection (1), by deleting "after the commencement* of the Landlord

and Tenant (Consolidation) (Amendment) Ordinance 1980"; and

(b) in subsection (1A)(b), by deleting "upon payment to him by the landlord

of" and substituting the following-

"the application for which endorsement shall be accompanied by".

Amendment of section 55.

15. Section 58(2) of the principal Ordinance is amended in the proviso by Amendment of deleting "45" wherever it occurs and substituting the following--

"55".

16. Section 59 of the principal Ordinance is amended-

(a) in subsection (2), by inserting after "subsection (1)" the following-

"and such fee as may be determined by the Financial Secretary”; and (b) by deleting subsection (3).
