HONG KONG BILL: DRAFT MEMORANDUM FOR LEGISLATIVE COMMITTEE

1.

I submit a draft memorandum on the Hong Kong Bill, to be circulated to the Cabinet Legislation (L) Committee. The

department's Legal Counsellor concurs.

2. The memorandum will need to be sent to the Secretary to the (L) Committee for circulation no later than 2 January in preparation for the meeting on 9 January. The Hong Kong Bill itself will be sent

separately by Parliamentary Counsel.

3. The memorandum summarises in paras 10-11 Exco's consideration of

the draft Bill. I am submitting separately a draft telegram instructing the Governor to inform Exco, at its next meeting on 3

January, of the Secretary of State's decision that nationality

provisons should be retained in the Bill.

4. I understand that Lady Young will attend the Committee on 9

January. I shall submit briefing in due course.
