HONG KONG BILL: INSTRUCTIONS TO PARLIAMENTARY COUNSEL

In the absence of any comments on the Secretary of State's

minute of 5 November we can now as sume the agreement of members of QL and OD (K) that we should proceed with the legislation on the Hong Kong agreement. I submit draft instructions to Parliamentary Counsel, to be despatched to the First Parliamentary Counsel under a letter from the Second Legal Adviser.

As the Secretary of State is aware EXCO was consulted on the outline of the proposed legislation. The draft instructions have also been cleared with the Hong Kong Government, which is generally content, subject to the clarification of one point relating to the acquisition of the new nationality status by Hong Kong BDTCs. We are pursuing this point separately, and the instructions to Counsel need not be affected. We shall also be clearing with the Hong Kong Government the Home Office paper on nationality which figures as Paper C attached to the instructions. We shall explain to Hong Kong that the draft legislation will be subject to continuing exchanges between our Legal Advisers and the draftsman. The passage on nationality in the instructions has been agreed with the Home Office.
