Instructions to Parliamentary Counsel
The Secretary of State was grateful for your minute of 12 November. He agrees that instructions should be given to Parliamentary Counsel. As you will see, he has made one comment, on paragraph 13, which may require an amplification of the instructions before they are forwarded. He has made a second comment, on paragraph 6, which, subject to your view, need not hold up despatch of the instructions.
The Secretary of State has also raised one point on your covering submission. As you will see, he wonders whether the proposal in paragraph 4 (a) that the enabling clause on the modification of statutes should be provided in such a way as to be subject only to annulment procedures as the usual course in such cases. Perhaps Mr Burrows could comment on this point?
