1. To obtain the Prime Minister's agreement to the paper on legislation on Hong Kong which it is proposed to circulate to the

members of OD (K) and QL.

RECOMMENDATION

2. I recommend that Private Secretary should write to the Private Secretary at Number 10 in terms of the attached draft letter. Legal

Advisers agree.

3. The Secretary of State is aware of the general background to this problem. The draft paper for circulation to members of OD(K) and QL has been amended to take into account the consensus on the form of legislation on nationality questions which has now been arrived at with the Home Secretary and the Lord President of the

Council.

Hong Kong have now been consulted, and the Governor has put the matter to the Executive Council. As recorded in Hong Kong telegram number 3350 some members of EXCO are not happy with the proposal to terminate sovereignty in the legislation itself, rather than by subsequent Order-in-Council. This is because in April when we were discussing problems related to the timing of ratification, we told them (although without making any commitment) that we were thinking of a procedure whereby the termination of sovereignty would be
