HONG KONG BILL: INSTRUCTIONS TO PARLIAMENTARY COUNSEL

I attach Mr Burrows' draft instructions to Parliamentary Counsel. We should return these to Mr Burrows with our comments and a revised passage on nationality to be provided by the Home Office. Mr Burrows will then provide revised instructions which we can submit to Sir P Cradock.
Mr Burrows advises that there is no need to seek the Secretary of State's approval. Two copies of the instructions will be sent to the First Parliamentary Counsel under cover of a letter from Mr Darwin, as acting Legal Adviser.
2. I have spoken to Lord Whitelaw's Office who assure me that there is no need to seek formal approval before putting instructions to Parliamentary Counsel. We can proceed as soon as we have OD(K) and QL approval. An amendment to the guide to legislative procedures will issue in due course.
3. I have made some pencilled amendments to the draft instructions.
