4. While the system of appointment and removal of judges will remain basically unchanged, the appointment and removal of judges "of the highest rank" will require the endorsement of the Legislature and have to be reported for the record to the Standing Committee of the NPC.
5. At present the decision whether or not to prosecute in any particular case is the responsibility of the Attorney General. In discharging that responsibility the Attorney General exercises an independent role, free from Government interference. The Agreement provides that that responsibility will continue to be exercised in the SAR in the same independent way.

Local lawyers and lawyers from outside Hong Kong, who contribute greatly both to the strength of the present legal system and to the success of Hong Kong as a commercial and financial centre, will continue to be enabled to practise law in Hong Kong. It is also provided that international arrangements can continue whereby, for example, judgments obtained in Hong Kong may be enforced in other jurisdictions for use in proceedings in Hong Kong.

PUBLIC SERVICE
1. This section provides for the continuation of Hong Kong's public service system, and for members of the Hong Kong Public Service to continue to serve under the Government of the SAR.
2. It states that those public servants serving in the Hong Kong public service will be able to continue to work for the SAR
Government on not less favourable terms of service. The SAR Government will continue to pay pensions to public servants of the Hong Kong Public Service who have retired. Foreign nationals will be able to continue to work in the public service of the SAR, as they do in the Hong Kong public service, but they will not be able to rise to the rank of Secretary.
