(a) Has the Assessment Office "faithfully" followed
the procedures presented in its terms of
reference ?
This seems to be a matter of reviewing the
terms of reference of the Assessment Office
and asking ourselves whether what the Office
has done in discharging its task
including
the scope and handling of its report
—
dealt
"faithfully" with all that its terms of
reference required. The media assessment
may present a special problem. Our answer
may quickly be "Yes"; but we may also wish
to note that the Assessment Office had to
go beyond its strict terms of reference
in arranging advertisements and dealing
with confidentiality.

(b) Has the Assessment Office discharged its
duties "properly" ?
We may wish to make clear that "properly" might be
regarded as covering "impartially" and also "accurately".
Having said that, we may wish to ask ourselves whether
the way in which the Assessment Office was staffed and
organized, and the modus operandi it adopted, proved
in practice capable of enabling it to discharge its
duties "properly" primarily in the sense of efficiently
and (I should perhaps add) in a way that commanded
/public
