TEST OF ACCEPTABILITY

As you know, the Secretary of State has appointed Sir Patrick Nairne and Mr Justice Simon Li to be members of the Monitoring Team to oversee the work of the office set up to asses S the acceptability of an agreement in Hong Kong.

We have already sought authority from the Treasury for the 2 members to be paid a daily fee of £143.00. This figure is the equivalent of Judge Li's monthly salary of 43,500 Hong Kong Dollars.

In Hong Kong telegram number 2548, Hong Kong said that they would seek reimbursement for this fee from us and also for "25 percent on costs for pension etc". This was the first we had heard of this request to be reimbursed for the 25 percent on costs. We therefore sent a telegram to 68) Hong Kong asking for breakdown of the costs covered by this 25 percent (telegram number 1726). The brakdown is contained in Hong Kong telegram number 2645.

Having studied this breakdown the Head of Hong Kong Department sent a personal telegram to the Governor (our telegram number 1085) asking whether it would be possible for the Hong Kong Government to waiver this extra charge. Having received no reply Mr Galsworthy again raised the matter with the Governor who is at present in London. The Governor said that his first reaction was that the FCO should pay the 25 per cent on costs but he would give the matter further consideration.

5. We are still awaiting for а definite reply from the Governor, but in the meantime I thought

bring this problem to your attention since we may have to pay this extra 25 percent.
