The basic principles will need to be set out in the Act,

but many detailed sections of Part I of the 1894 Act could

be repealed and re-enacted in modern statutory form in

subordinate legislation. This new element of flexibility

would enable changes and improvements to be made in the

future without the need for primary legislation.

22. Apart from changes in the form of the legislation,

the Government intends to retain all the main features of

the existing arrangements, including the 64 share system in

the case of multiple ownership, and the arrangements for

establishing title and recording mortgages against a ship.

The central registry will continue to receive regular returns

from Dependent Territories relating to ships on their registers,

to enable it to maintain a comprehensive register of all

British ships.

23. The Small Ships Registers referred to in paragraph 19

will continue to operate separately, thus offering an

alternative and simpler method of registration for eligible

ships under 24 metres in length.

V REGISTRATION OF FISHING VESSELS

24. The current arrangements for the registration of

sea fishing vessels are more complex than for merchant ships.

The essential difference is that such vessels are required

to be registered under Part IV of the 1894 Act, for which

no fee is charged and which neither conveys title nor provides
