Commonwealth countries

16.

The Act will not apply to independent Commonwealth

countries. Citizens of independent Commonwealth countries

and companies incorporated in those countries will not be

eligible to register ships on the British register.

Obligation to register

17.

There will be no change in the obligation to register

a British ship, the exemptions from registration currently

in force, or the penalty for failure to register an eligible:

Qualifications for owning a British ship

18.

The requirement that a ship shall be deemed to be

British only if it is wholly owned by qualifying persons

will be retained, but the definition of persons qualified

to be owners of British ships will be amended as follows to

reflect the narrower scope of the legislation, and the need

to ensure that there is an established legal person in the

country of registration for the purpose of enforcement and

jurisdiction.

a) British Citizens and British Dependent Territory

Citizens as defined in the British Nationality

Act 1981.

Such citizens will be expected to register their ships in

their own territory but will have the right to register in

the UK (or in another territory) if registration facilities
