I spoke to you this morning about the draft working paper in Hong Kong telno 115 of 16 January. I asked whether it was thought desirable to allow existing leaseholders not to have their existing leases extended, if that was their wish.

Since speaking I have received Hong Kong's Memorandum for the Executive Council XCS (84)5 (on HKK 040/14).1903 Paragraph 10 of that paper does indeed say that it would be desirable to allow leaseholders to opt to continue on their present lease conditions if they so wished, "ie at a nominal rent but with the term expiring in 1997". In view of this we might suggest to Hong Kong that the last sentence of paragraph 6 of the draft working paper in Hong Kong telno 115 should be amended by adding at the end

if the lessees so wished." A corresponding amendment would then need to be made in the draft in Hong Kong telno 116.
