INTERNATIONAL CONVENTIONS APPLYING AT THAT TIME TO HONG KONG
(CHINA): THE APPOINTMENT OF SURVEYORS ABROAD TO SURVEY HONG KONG
SHIPS ON BEHALF OF THE GOVERNMENT OF THE SAR: THE SURVEY AND
CERTIFICATION OF SHIPS REGISTERED IN OTHER COUNTRIES WHICH WERE
PARTIES TO THE SAME CONVENTIONS, AT THE REQUEST OF THE
AUTHORITIES OF THE FLAG STATE: AND THE ENFORCEMENT OF
INTERNATIONAL CONVENTION REQUIREMENTS ON FOREIGN SHIPS VISITING
HONG KONG. IN ALL THESE RESPECTS, THE MARITIME ADMINISTRATION OF
THE GOVERNMENT OF THE SAR WOULD CONTINUE TO DISCHARGE THE DUTIES
OF A FLAG STATE AND A PORT STATE AS IT DOES AT PRESENT.
3. AS PART OF THESE FUNCTIONS IT WOULD BE RESPONSIBLE FOR
DEVELOPING MARITIME LAW AND REGULATIONS DESIGNED TO DISCHARGE
INTERNATIONAL OBLIGATIONS RELATING TO MARITIME SAFETY, POLLUTION
PREVENTION AND EMPLOYMENT STANDARDS, AND TO REGULATE HONG KONG
SHIPPING AS NECESSARY.
THE PORT OF HONG KONG
4. HONG KONG WOULD REMAIN A FREE PORT AND ITS ADMINISTRATION
WOULD BE EXCLUSIVELY A MATTER FOR THE GOVERNMENT OF THE SAR. THE
PORT MANAGEMENT STRUCTURE UNDER THE LOCAL MARITIME ADMINISTRATION
AS IT EXISTED IMMEDIATELY PRIOR TO 1 JULY 1997, WOULD REMAIN
UNCHANGED.
FINANCIAL ASPECTS
5. THE GOVERNMENT OF THE SAR WOULD RETAIN THE AUTHORITY TO SET
AND COLLECT FEES FOR SHIP REGISTRATION, MARINE SURVEYS AND OTHER
SERVICES, PORT DUES, LIGHT DUES, PILOTAGE AND OTHER CHARGES
RELATING TO PORT AND SHIPPING FACILITIES.
SHIPPING SERVICES
6.
THERE WOULD BE NO CHANGE IN THE REGIME FOR SHIPPING SERVICES
LINKING HONG KONG AND OTHER PORTS.
INTERNATIONAL AGREEMENTS
7. AS HONG KONG, CHINA' THE GOVERNMENT OF THE SAR WOULD REMAIN
AN ASSOCIATE MEMBER OF THE INTERNATIONAL MARITIME ORGANISATION.
IT WOULD HAVE THE AUTHORITY TO JOIN OTHER INTERNATIONAL
ORGANISATIONS AND TO PARTICIPATE IN CONFERENCES NOT LIMITED TO
STATES. ACTION WOULD BE TAKEN BY THE BRITISH AND CHINESE
GOVERNMENTS TO FACILITATE THE CONTINUED APPLICATION TO HONG KONG
