AMENDMENTS TO LETTERS PATENT AND ROYAL INSTRUCTIONS
1. Thank you for your letter of 30 November to Tony Galsworthy, who is at present on leave.

The draft amendments attached to your letter have been carefully considered by Paul Fifoot, a Deputy Legal Adviser here. I attach a self-explanatory minute and redrafted amendments sent by him to the Department.
3. I am sure that Fifoot is right in his view that all the provisions relating to elected members could best be set out in local Hong Kong legislation and (his paragraph 3) that we should now begin considering what other parts of the Letters Patent and Royal Instructions should be transferred in the same way.
4. On timing, you will note Fifoot's view that the Letters Patent at least will need to be amended before the electoral legislation is enacted by the Legislative Council (and preferably before it is introduced). We doubt if this process can be completed by early February, although it should be possible by mid-March if we are able to reach agreement soon on the amendments to be made to the Letters Patent and the Royal Instructions. While you are considering Fifoot's redraft, we will make whatever advance preparations we can so that the processing of the amendments takes as little time as possible.
Our Legal Advisers look forward to an early sight of your draft ordinance, even in embryo.
