Following consideration of Memorandum XCC (84) 115 30 October 1984, this Council advised and the Governor ordered-

"that a further submission should be made to Members as soon as possible on nationality requirements for voting and candidates in the electoral legislation".

Electors

Under the Electoral Provisions Ordinance (Chapter 367), a person is not entitled to be registered as an elector unless he has ordinarily resided in Hong Kong for seven years immediately preceding the date of his application for inclusion in the register or he is a Hong Kong belonger. Under this Ordinance, there is no citizenship or nationality requirement.

In the United Kingdom, a person must be a British subject or a a citizen of Ireland to qualify for the vote. In Australia, the status of the British subject is necessary, and in Canada, Canadian citizenship is a requirement.

Candidates

Section 18 of the Electoral Provisions Ordinance (Chapter 367) provides that an

elector who has been 10 years ordinarily resident in Hong Kong is qualified for nomination as a candidate.

A person may not be nominated if he is a member of any parliament, assembly or council, whether central or local, of a foreign country or a salaried functionary of a foreign government.

In the United Kingdom, Australia and Canada, the status of an alien is a disqualification.
