Dear Sir,
As I have reported to you on the telephone, I have this afternoon had a meeting with the legal advisers for BMFL, CHL and CIL and for Mr. Tan personally. I have also received draft letters to eligible creditors of CIL and CHL from you as financial advisers to the companies.
The advisers to BMFL maintained the correctness of its books which were audited both internally and externally, as well as having been examined by the Banking Commissioner of Hong Kong. For Carrian, it was also said that the published schemes gave a correct record of their books. For Mr. Tan, it was stated that he had gone on record to his Board that, to his knowledge, there was other scheme outside the published schemes, but as yet he had not given any explanation of his letter of 15th January, nor could he undertake that any explanation would be forthcoming. For ease of reference I enclose a copy of the note left with for BMFL.
As you will see, the representatives of BMFL said that they were willing, in principle, to accept with no legal commitment at this stage a proposal from Mr. Tan whereby Mr. Tan and his family-controlled companies
(except CHL) take up the disputed amount and upon formal acceptance, after full investigation, to join the CHL scheme. I told the advisers to the company that I presumed that they would be advising you about the conclusion of the meeting.
From my part, I stressed that I thought it essential that a letter should go out, if possible, tonight to eligible creditors. I said to them that I would be confirming to you that I was content for you to use the wording in your draft letter.
