Amendment of section 2 of Cap. 74.

Immigration Control (Amendment) Ordinance, 1983.

2. The Immigration Control Ordinance (hereinafter call- ed the principal Ordinance) is amended by renumbering sec- tion 2 as subsection (1) of that section, and by adding the following new subsections:

"(2) For the purposes of this Ordinance, a British Depen- dent Territories citizen has a connection with Gibraltar if but only if, at least one of the following criteria is applica- ble to him and he fulfills all of the following criteria that are applicable to him:

"(a) where his birth in a dependent territory

is a material qualification, that he was born or is deemed under the British Nationality Act, 1981, to have been born in Gibraltar:

"(b) where the citizenship of one of his par- ents at any time after commencement is a material qualification, that that par- ent is at that time or is deemed under the British Nationality Act, 1981, to have been at that time a British Depen- dent Territories citizen having a con- nection with Gibraltar:

"(c) where the fact that one of his parents has at any time settled in a dependent territory is a material qualification, that that parent is at that time settled, or is deemed under the British Nationality Act, 1981, at that time to have been set- tled, in Gibraltar:

"(d) where Crown service under the Govern- ment of a dependent territory is a mat- erial qualification, that the dependent territory is Gibraltar:

"(e) where the person is a British Depend- ent Territories citizen by virtue of reg- istration, or by virtue of an adoption order, that he was so registered in Gib- raltar or, as the case may be, that the adoption order was made in Gibraltar;
