NOTE BY THE ATTORNEY GENERAL

CHARGE AND CONVICTION

1.

The petitioner,

aged 22 years

was convicted in the High Court of Hong Kong on the 24th July 1981 of the following charges:-

Count 2

Count 3

On the 18th day of September, 1980 at Flat A, 208-214 Hollywood Road, 18/F., in this Colony, he

murdered

On the same date and at the same place he murdered

LEUNG Kim.

On the same date and at the same place he robbed

of various property.

The petitioner pleaded not guilty to Counts 1 and 2 and guilty to Count 3. On each of Counts 1 and 2 he was sentenced to death and on Count 3 was sentenced to six years' imprisonment. On the 17th of March 1982 the Court of Appeal refused leave to the petitioner to appeal against his convictions on Counts 1 and 2.

FACTS

The victim HO Siu-tuen (hereafter "the first deceased") was the wife of the petitioner's uncle who operated a ginseng and dried seafood business at which place the petitioner was employed from approximately 1974 until August of 1980 and the other victim LEUNG Kim (hereafter "the second deceased") was an amah working for the HO family.

In August 1980 the petitioner left his employ at the uncle's business as a result of an argument, the result of an allegation by the uncle that the petitioner had stolen $200 in currency from the clothing of a fellow employee. About one week after leaving that employment the petitioner was given a position with a security company and on the 16th of September the petitioner asked for one day's leave on the 18th of September 1980.
