accomplice concealed the drugs at the bottom of a suitcase. It was arranged that CHAN Kay Yan and his girlfried,
King, were to travel to Paris together on 16th May 1979, carrying a suitcase containing the heroin.
King
was arrested in possession of the suitcase at Charles De Gaulle Airport, Paris and subsequently sentenced to 4 years imprisonment in France for possession of the heroin.

The deceased went to Paris, and subsequently to the Netherlands where he obtained 19,000 Dutch Guilders in compensation from earlier accomplices in a 1978 consignment of drugs which had been lost.

The petitioner eventually learned that the deceased had money to spend in Europe and that there had been no media reports of the heroin assignment having been seized in Paris. The petitioner concluded that he had been cheated and began to discuss with his friend, TAM Ho Kin and the second accused,
how to recover the money that had been lost and how to kill the accused. On one occasion they went to a temple in Shatin where they performed a ceremony which purported to join them in their enterprise as blood brothers. Thereafter the petitioner rented a flat in Yuen Long under a false name and told TAM Ho Kin that he planned to lure the deceased to the flat where he would be killed, his body dismembered and a mincing machine used to dispose of his flesh. At this stage TAM HO Kin withdrew from the agreement.
6. The deceased left his flat about noon on 7th August 1979 telling his wife he was keeping an appointment with the petitioner. They met and were driven to Yuen Long by CHIANG Fat Kuen. The deceased had been told to expect to be introduced
