9. The pathologist - Dr. LEE Fook-kay formed the opinion that the
j.deceased died between the hours of 9 a.m. and 12 noon on 28th January
1981. Upon examination he found inter alia, a horizontal tight ligature
mark encircling the neck at the level of the voice box; ante mortem
ligature marks at both wrists which in his opinion were due to
securing both wrists together. He found a similar ligature mark
encircling the lower part of both legs near the ankles. One of the
ligatures was an electric wire and the other was a nylon cord
which latter Doctor LEE said was clearly encirculing the neck at the
voice box when he first saw the body at the scene, in the early hours
of 29th January 1981. He observed some signs of resistance to the
gagging from finger nail marks and scratches over the facial area.
In Doctor LEE's opinion death was caused by asphyxia due to
stranguiation by ligature by the exercise of a degree of force from
moderate to severe. He said that the strangulation was deliberate.
ARREST AND CONFESSION
10. The convict having departed the scene late at night on 28th January
1981 returned to the but on 29th January 1981 at about 10.40 p.m. where
he was arrested by a party of police officers who had been lying
in wait for him in case he should appear there.
The convict was interviewed and cautioned as a matter of routine
police procedure after which he made a statement which was reduced to
writing. To summarise this statement was a confession by
him of a premeditated plan to kill the deceased and her brother
YEUNG Wai-chung with an inference that he intended to commit
suicide after that. He also indicated in the confession statement
that the motive for the killing was because he had been heartlessly
treated, in his opinion, by the failure of YEUNG Wai-chung and the
