NOTE BY THE ATTORNEY GENERAL

The Petitioner,
(24 years of age) vas
charged with the murder of LEUNG Kit-ying. He was convicted of murder on the 19th of September 1979.
appeal was dismissed on the 5th day of May, 1980.
FACTS

Shortly before 9 a.m. on the 4th April 1979, a caretaker
at Star House, Tsim Sha Tsui heard a voice in room 1201 call out "Save life". In response to some knocks on the door and
shouts from the caretaker a few minutes later the office door-
was unlocked from inside and the petitioner came out. He had
bloodstains on his suit-coat and shirt. He fell to the floor
in the corridor and cried out "Save life" on several occasions.
After a short time he got up and started to walk away from the office along the corridor. When a caretaker asked him where he was going, he sat down on the floor with his back against the wall. The door of Room 1201 was then fully opened and the deceased was discovered lying near the doorway of the office. He had mutliple wounds to the head and body including some stab- wounds. He appeared unconscious, he was covered in blood and
there was a pool of blood on the floor beside him. The petitioner was then observed to come back inside the office, call out "Andy"
and fall beside the deceased.

The police arrived shortly thereafter and made a detailed examination of the scene. They found that one window was opened and upon looking out and down onto a ledge they saw a hammer about a foot long resting on it. The police also observed a fruit knife inside the office which appeared to have bloodstains on it. It was noted that the articles in the office were not in any real disarray, that the entrance door and drawers inside the office showed no signs of having been prized open, nor did the open window.
