The evidence disclosed that this was an armed robbery of the most deliberate and callous type, and the evidence as to the circumstances surrounding the killing fully justified the jury's verdict in respect of the murder count. Furthermore there was evidence from the accomplice,
and from
other persons present at the casino at the time of the robbery, that the offenders continued to systematically rob gamblers and casino employees even after the deceased had been fatally wounded. There was evidence that
was heard to say in
respect of the deceased "See if he is dead, if not give him one more shot". There was testimony that the patrons of the casino were told to hand over their monies and valuables or they would be shot to death.

All the prisoners are men of bad-character with previous convictions for violent crime.
MITIGATING CIRCUMSTANCES*

There appear to be no mitigating circumstances in favour of these three petitioners who took part in what was a well planned and brutal offence.
