I also suggest that, even if there had been evidence that the accused did have a lower flashpoint than the ordinary man, this consideration would be relevant to the length of any sentence (if commutation were ordered) in so far as the need to protect the public from any repetition was concerned. It should not relate solely to mitigation.

RECOMMENDATION

30.

If His Excellency the Governor decides to commute the death sentence I recommend that a sentence of 25 years of imprisonment be substituted.
