gratuity of an officer to whom such paragraph applies, where appropriate his continuous daily paid service prior to transfer to monthly paid service shall be deemed to be monthly paid service as if he had so elected under regulation 28(1)(b)."; (iv) in paragraph (5)—

(A) by inserting after "trial in any office" the following- "following service otherwise than on probation or trial"; and

(B) by deleting "actual" in each place it occurs in the

proviso;

(k) in regulation 30, by inserting at the end thereof after "words

may appear" the following-

and as though the words "regulation 26(4)(c), (cc) or (d)" were substituted for the words "section 6(c), (d) or (e)" ".

An Ordinance to amend the Employment Ordinance.

1. This Ordinance may be cited as the Employment (Amendment) Short title and Ordinance 1982 and shall come into operation on 1 January 1983.

2. Section 39 of the principal Ordinance is amended-

(a) in subsection (1)—

(i) in paragraph (a) by inserting after "Day" the following-

"or, if Lunar New Year's Day or the second or third day of Lunar New Year falls on a Sunday, then the day im- mediately preceding Lunar New Year's Day"; and

(ii) in paragraph (f) by inserting after "Festival" the following- "or, if that day falls on a Sunday, the Chinese Mid-Autumn Festival Day";

(b) in subsection (3) by deleting "An" and substituting the

following-

"Subject to subsection (4), an";

(c) by deleting subsections (4) and (5) and substituting the following

subsections

"(4) Where-

(a) a statutory holiday or an alternative or a substituted holiday falls on a rest day, or in the case of a female employee or an employee who is a young person, on a day on which, by virtue of the Women and Young Persons (Industry) Regulations, the employment of the employee in an industrial undertaking is not allowed, the employee shall be granted a holiday on the next day thereafter which is not a statutory holiday or an alternative holiday or a substituted holiday or a rest day; or (b) a statutory holiday falls on the Monday immediately following the second Saturday in June or on the last Monday in August an employee shall be granted a holiday on the next day thereafter.

(5) In addition to the holidays granted by subsection (1) an employee shall each year be granted two holidays by his employer on days to be fixed by the employer not being holidays under subsection (1), alternative holidays or sub- stituted holidays.";
