I am replying to your letter of 4 March to Humphrey Atkins
as he is overseas at the moment.
As you say, the matter is essentially one for the Hong Kong Government. While the law in Hong Kong makes homosexual acts, even between consenting male adults, an offence it is clearly right that the Hong Kong Government should consider carefully the propriety of employing homosexuals. However, I should emphasise that the guidance in the circular is applied flexibly. The Hong Kong Government have assured us that all applications are considered case by case. Each is examined with careful regard
to the nature of the work to be done, whether an offence was committed and the degree of risk involved in employing the applicant. The cases of those already in the public service are considered on a similar basis.
